You are responsible for how you use the App, how you interpret App outputs, and any decisions you make based on the App. 4. Local app profile, not a server account Nodisey does not provide a custom server-based account system. Any “account”, “profile”, or “delete account” wording inside the App refers to your local app profile and related local app data on your device. The developer does not operate a separate account server and does not control your Apple ID, Apple Account, App Store account, device settings, iOS settings, iPadOS settings, subscription settings, device backups, or Apple-managed services. Deleting or resetting your local app profile may remove local app data from the device, but it does not necessarily affect Apple-managed subscription records, App Store purchase history, device backups, system diagnostics, or other Apple-controlled records. 5. Local-first storage and no custom cloud account Nodisey is designed around local device storage and Apple system frameworks. The App does not operate a custom backend account server for user notes, drawings, files, scans, audio, PDFs, or profile data. The developer does not provide a separate cloud sync service for your App content. Your data may be affected by Apple-controlled device behavior, iOS/iPadOS behavior, device backups, App Store systems, StoreKit, Apple Intelligence, Translation, Speech, Spotlight, Siri, system share sheets, and other Apple frameworks or device services. The developer does not control Apple’s operating systems, device backups, Apple Account behavior, device storage, system permissions, App Store behavior, StoreKit behavior, diagnostics, or Apple service availability. 6. No sole storage The App should not be used as the sole storage location for important, sensitive, legal, financial, medical, academic, business-critical, emergency, compliance-critical, password, security, or mission-critical information. You are responsible for keeping separate backups of important data outside the App. The developer cannot be held responsible for lost notes, lost drawings, lost PDFs, lost images, lost audio, lost transcriptions, lost study cards, lost folders, lost reminders, lost exports, corrupted files, unavailable data, accidental deletion, failed deletion, failed saving, failed migration, failed restore, device failure, insufficient storage, operating system behavior, user mistakes, or other data-related loss, to the maximum extent permitted by law. 7. You agree not to use the App to create, store, process, scan, import, record, export, or share content that: - Is unlawful, harmful, abusive, defamatory, harassing, deceptive, or fraudulent - Infringes intellectual property, privacy, publicity, confidentiality, or other rights - Contains malware, harmful code, or intentionally disruptive content - Violates platform rules, applicable laws, or third-party rights - Is used for illegal surveillance, impersonation, fraud, harassment, or other harmful activity The developer does not review, approve, verify, endorse, or take responsibility for user-created or user-imported content. 8. Intellectual property and content rights You retain any rights you lawfully hold in the content you create or import into the App. You are responsible for ensuring that you have the necessary rights, permissions, licenses, and consents for any content you import, capture, scan, record, edit, export, or share through the App. The App, including its software, design, interface, structure, original code, branding, and non-user content, is protected by intellectual property laws. You may not copy, modify, redistribute, resell, or create derivative works from the App except as allowed by these Terms or mandatory law. The developer cannot be held responsible for copyright, licensing, trademark, privacy, confidentiality, or other legal issues caused by content selected, imported, captured, scanned, recorded, generated, exported, copied, or shared by users. 9. Notes, folders, drawings, PDFs, scans, and study tools Nodisey may help you create and organize notes, folders, drawings, PDFs, scanned documents, source clips, linked notes, study cards, and review material. These tools are provided for personal productivity and organization only. They do not guarantee learning outcomes, academic performance, productivity gains, completeness, correctness, availability, or preservation of your content. Study cards, summaries, related-note suggestions, search results, extracted text, generated text, translations, transcriptions, and other App outputs may be incomplete, inaccurate, outdated, duplicated, missing, or unsuitable for your situation. You are responsible for reviewing all important content before relying on it, submitting it, sharing it, exporting it, printing it, studying from it, or making decisions based on it. 10. Locked notes and device authentication Nodisey may include a note-locking feature that uses Apple device authentication, such as passcode, Face ID, Touch ID, or other system-supported authentication where available. Locked notes are intended to reduce casual access inside the App. They are not a separate secure vault, password manager, legal-grade encryption product, enterprise security system, or guaranteed protection against all access. Locked-note behavior depends on Apple’s LocalAuthentication framework, device settings, passcode settings, biometric settings, operating system behavior, device security, user actions, and physical/device access conditions. The developer cannot be held responsible for unauthorized access, data exposure, screenshots, screen recordings, backups, device compromise, shared device access, user mistakes, operating system behavior, authentication failure, authentication bypass caused by Apple system behavior, or other security issues outside the developer’s control. Do not store passwords, cryptographic keys, financial credentials, identity documents, medical records, legal secrets, trade secrets, or other highly sensitive information in the App as your only protection method. 11. Local notifications and reminders Nodisey may use local notifications for note or block reminders. Local notifications depend on iOS/iPadOS, device settings, notification permissions, Focus modes, battery settings, time settings, device state, system limits, and Apple system behavior. The developer cannot be held responsible for missed, delayed, duplicated, hidden, silenced, failed, inaccurate, or unavailable notifications or reminders caused by iOS/iPadOS behavior, permissions, Focus modes, battery settings, time changes, device state, system limits, user actions, or any factor outside the developer’s control. The App must not be used for emergency, medical, legal, safety-critical, financial, business-critical, or mission-critical reminders. 12. Camera, photos, scans, and media Nodisey may request access to the camera, selected photos, or photo-library saving permissions only when you use related features, such as choosing a profile image, adding an image to a note, capturing a photo, scanning a document, annotating or saving an image, or saving selected images to the photo library. You are responsible for the images, documents, files, and media you select, capture, scan, import, annotate, store, delete, export, or share. The developer cannot be held responsible for image quality, camera quality, failed captures, failed saves, failed imports, failed scans, incorrect document detection, cropping errors, OCR errors, file corruption, accidental imports, accidental deletions, user-selected content, copyright issues, privacy issues, or issues caused by camera permissions, photo permissions, device hardware, iOS/iPadOS behavior, or Apple photo library controls. 13. Audio recording and speech transcription Nodisey may allow you to record audio notes and create transcriptions from selected audio using Apple system speech recognition where available and authorized. Audio recording and transcription depend on microphone permissions, speech recognition permissions, device hardware, iOS/iPadOS behavior, supported languages, audio quality, background noise, Apple speech services, on-device recognition availability, network/system conditions where applicable, and Apple framework behavior. The App may request on-device speech recognition when Apple’s system framework supports it, but availability and behavior are controlled by Apple and the device. Transcriptions may be incomplete, inaccurate, delayed, unavailable, or unsuitable for your needs. You are responsible for reviewing all transcriptions before relying on them. You are responsible for complying with all applicable laws and obtaining all necessary consents before recording, transcribing, storing, exporting, or sharing audio that includes other people, private conversations, confidential information, copyrighted content, or regulated information. The developer cannot be held responsible for unlawful recordings, missing consent, inaccurate transcription, failed transcription, audio loss, audio quality problems, permission issues, Apple speech recognition behavior, or consequences caused by relying on transcripts. 14. Text recognition, scanning, QR codes, and extracted data Nodisey may use Apple system frameworks to recognize text, handwriting, document content, QR codes, barcodes, or other supported data from selected images, scans, camera input, PDFs, drawings, or other user-provided content. Recognition results may be inaccurate, incomplete, unavailable, delayed, duplicated, misread, or unsuitable for your specific use. You are responsible for verifying extracted text, links, codes, contact-like data, dates, addresses, numbers, or any other recognized information before using, saving, opening, exporting, sharing, or relying on it. The developer cannot be held responsible for incorrect recognition, failed scanning, wrong links, wrong codes, missed text, misread handwriting, inaccurate search indexing, or any consequences from relying on extracted data. 15. Links and external content Nodisey may allow you to create, store, open, or export web links or recognized links. Links may lead to external websites, apps, files, services, or content that are not owned or controlled by the developer. You are responsible for the links you add, open, share, or rely on. The developer cannot be held responsible for external websites, external files, external apps, broken links, malicious links, inaccurate link metadata, phishing, external privacy practices, external terms, or any consequences caused by opening or sharing external content. 16. Apple Intelligence, Foundation Models, and generated outputs Nodisey may use Apple Intelligence / Foundation Models or other Apple system-supported language model functionality where available on your device, in your region, and under your Apple settings. These features are powered by Apple system frameworks and Apple-controlled model availability. The developer does not operate a separate AI server for these features, does not control Apple’s model behavior, does not control Apple Intelligence availability, does not control Private Cloud Compute behavior where Apple uses it, and does not guarantee model quality, availability, speed, language support, or output accuracy. Generated summaries, writing suggestions, study material, titles, transformations, explanations, or other AI-assisted outputs may be inaccurate, incomplete, misleading, offensive, biased, unsuitable, outdated, or inappropriate for your situation. AI-assisted outputs are not professional advice. They should not be relied on for medical, legal, financial, academic, safety-critical, emergency, compliance, or business-critical decisions without independent review by a qualified person. You are responsible for reviewing, editing, verifying, and deciding whether to use any AI-assisted output. The developer cannot be held responsible for losses, missed tasks, poor decisions, academic outcomes, business outcomes, financial outcomes, legal consequences, emotional distress, reputational harm, or other consequences caused by relying on AI-assisted output. 17. Translation features Nodisey may use Apple’s system Translation framework to translate selected text where available. Translation availability, supported languages, quality, downloads, system UI behavior, and processing behavior are controlled by Apple and the device. Translations may be inaccurate, incomplete, culturally inappropriate, unavailable, delayed, or unsuitable for legal, medical, financial, academic, business, emergency, or official use. You are responsible for reviewing translations before relying on them. The developer cannot be held responsible for translation errors, misunderstandings, losses, missed obligations, incorrect communication, or consequences caused by relying on translated text. 18. Deep search, Spotlight, Siri, Shortcuts, and App Intents Nodisey may provide search, local indexing, Spotlight indexing, Siri, Shortcuts, App Intents, and system navigation features. If you use system search, Siri, Shortcuts, or other Apple-provided surfaces, some App-related information may be handled by Apple system features according to Apple’s own settings and policies. 19. Sharing, export, and saving Nodisey may allow you to share, export, copy, save, or send content using Apple system share sheets, exported text, RTF, PDF, images, or other supported formats. Exports and shares depend on App content, file size, file format, destination apps, Apple system share sheets, device storage, permissions, and third-party destination behavior. You are responsible for reviewing exported files, filenames, file contents, formatting, metadata, recipients, destinations, and privacy implications before sharing or saving. The developer cannot be held responsible for formatting changes, export failure, missing content, corrupted files, unsupported files, failed saves, wrong recipients, accidental sharing, external app behavior, third-party destination behavior, disclosure after sharing, screenshots, screen recordings, manual copying, or any external use of content after you share or expose it. 20. Data deletion, reset, and app removal Nodisey may include local delete/reset controls for local profile data and local app content. Local deletion may be affected by device state, file availability, storage errors, operating system behavior, app state, interrupted operations, user actions, backups, and Apple-controlled systems. The developer cannot guarantee that every copy, cache, temporary file, system index, device backup, diagnostic record, exported file, shared copy, screenshot, screen recording, recipient copy, or Apple-controlled record will be deleted by an in-app local reset. Deleting the App may remove local app data from the device, but it may not remove Apple-managed purchase history, App Store records, subscriptions, device backups, system diagnostics, exported files, shared files, or copies stored outside the App. You are responsible for managing your device backups, exported files, shared files, screenshots, recordings, Apple Account, App Store subscriptions, and any copies outside the App. 21. Device storage, file integrity, and backups Nodisey depends on device storage, local files, Apple file systems, Apple frameworks, and the operating system. Insufficient device storage, interrupted writes, app termination, operating system bugs, device failure, file corruption, storage restrictions, permission changes, user deletion, failed updates, failed migrations, device restore behavior, or unsupported configurations may prevent saving, loading, exporting, deleting, migrating, indexing, or restoring data. The developer cannot be held responsible for delayed Pro access, failed entitlement refresh, subscription state mismatch, App Store account issues, StoreKit outages, regional restrictions, Apple Account issues, payment failures, pending approvals, refund effects, revocations, Family Sharing behavior, or Apple-controlled subscription behavior. 24. Pro feature changes Pro features may be modified, added, removed, renamed, limited, replaced, suspended, or discontinued over time for technical, legal, security, performance, product, business, App Store compliance, Apple policy, or platform reasons. A subscription provides access to the Pro features available at the relevant time. It does not guarantee that every feature, design, limit, workflow, model capability, Apple framework integration, export option, note limit, or capability will remain unchanged permanently. The developer cannot be held responsible for loss, inconvenience, subscription dissatisfaction, workflow changes, unavailable Pro features, modified Pro features, removed Pro features, changed Pro limits, AI/model availability changes, Apple framework changes, or App Store/StoreKit behavior. 25. Free limits and feature availability Nodisey may include free usage limits, including limits on the number of notes or access to selected features.
