Terms of Use for Ultrasyde Last updated: August 31, 2026 These Terms of Use (“Terms”) govern your access to and use of Ultrasyde (“Ultrasyde” or the “App”), provided by Ali Yiğit (“Developer”, “we”, “us”, or “our”). By downloading, installing, accessing, subscribing to, or using the App, you agree to these Terms. If you do not agree, do not use the App. 1. Developer Ultrasyde is provided by: Ali Yiğit Email: aliyigxt@icloud.com 2. Relationship with Apple Ultrasyde is distributed through the Apple App Store. The App is licensed, not sold. Unless a custom end-user license agreement is separately provided through Apple for the App, your license to use Ultrasyde is also subject to Apple’s applicable Licensed Application End User License Agreement (“Apple Standard EULA”), Apple Media Services Terms and Conditions, App Store usage rules, StoreKit rules, and other mandatory Apple terms that apply to your device, Apple Account, purchases, subscriptions, or Apple-managed services. These Terms supplement the applicable Apple terms. They do not reduce rights that cannot lawfully be limited. If these Terms conflict with mandatory Apple terms or mandatory applicable law, the mandatory terms or law control to the extent of the conflict. Apple is not responsible for providing maintenance or support for Ultrasyde except to the extent required by Apple’s own terms or applicable law. Apple and its subsidiaries may have rights as third-party beneficiaries under applicable Apple license terms. 3. License Subject to these Terms and applicable Apple rules, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to use Ultrasyde on Apple-branded devices that you own or control, or otherwise as permitted by Apple’s applicable usage rules. No ownership interest in the App is transferred to you. 4. Prohibited Use You may not, except where applicable law expressly permits otherwise: • Copy, resell, rent, lease, sublicense, distribute, or commercially exploit the App itself • Reverse engineer, decompile, disassemble, modify, translate, or attempt to derive the App’s source code, algorithms, non-public data structures, or protected technical mechanisms • Circumvent, disable, manipulate, or interfere with subscriptions, premium entitlements, free-use limits, security controls, permissions, access restrictions, or technical safeguards • Use automation, scraping, extraction, probing, or abusive technical methods against the App • Interfere with the App, Apple services, the App Store, StoreKit, device security, or other users • Use the App for unlawful, fraudulent, infringing, abusive, harmful, deceptive, or rights-violating purposes • Misrepresent simulated, calculated, estimated, generated, or visualized App content as professionally certified or independently verified information • Use the App in violation of applicable law, Apple terms, export controls, sanctions, or third-party rights 5. Nature and Purpose of Ultrasyde Ultrasyde is an astronomy, space visualization, simulation, exploration, and photography-oriented application. The App may provide interactive representations of celestial objects, astronomical events, sky views, simulated space travel, date and time simulation, location-dependent astronomical information, camera-based sky visualization, and related educational or entertainment-oriented features. Ultrasyde is not a professional observatory service, certified ephemeris service, scientific certification system, navigation system, surveying instrument, aviation or marine navigation tool, emergency service, safety system, telescope-control certification system, or substitute for professional astronomical equipment. 6. Simulation, Visualization, and Generated Content Ultrasyde combines calculated, simulated, approximated, visualized, catalog-based, and, where applicable, procedurally generated representations. Visual scale, brightness, color, apparent size, spacing, movement, speed, atmosphere, object density, orbital presentation, travel effects, deep-space environments, and other visual or simulated characteristics may be adjusted, simplified, approximated, generated, or stylized for usability, performance, presentation, exploration, or simulation purposes. A visual representation in Ultrasyde must not be interpreted as a guarantee that the represented object, environment, distance, appearance, position, physical condition, route, or relationship would appear exactly the same in reality. Hyperspace, pilot, flight, time-travel, and similar App concepts are simulation features. They do not represent real spacecraft operation, transportation, physical travel, or a prediction that such travel is possible. 7. Astronomical Calculations and Events Ultrasyde may calculate or display information such as celestial positions, phases, rise and set information, astronomical events, conjunctions, eclipses, seasonal events, orbital relationships, dates, times, or other astronomy-related results. Astronomical results can be affected by mathematical approximations, supported date ranges, observer position, altitude, atmospheric assumptions, time zone, device date and time, calendar behavior, location accuracy, sensor accuracy, catalog limitations, numerical precision, implementation limits, operating-system behavior, and other factors. Results may be inaccurate, incomplete, unavailable, delayed, rounded, approximated, or different from professional astronomical publications or measurements. You are responsible for independently verifying any astronomical information where accuracy matters, including observation planning, research, education, photography planning, telescope alignment, travel, public events, or any other consequential use. The Developer does not guarantee the timing, visibility, duration, magnitude, classification, position, or observability of any astronomical event. 8. Solar and Observation Safety Ultrasyde does not provide certified eye-safety, solar-observation, equipment-safety, or physical-observation instructions. Never look directly at the Sun through your eyes, a camera optical system, binoculars, a telescope, or other optical equipment without appropriate certified solar protection and proper safety procedures. You are responsible for safely using any device, camera, telescope, mount, tripod, vehicle, or other equipment while using the App. 9. Location, Maps, Heading, Altitude, and Environmental Data Certain Ultrasyde features may use a location you select manually or location information made available by your device, depending on your choices and permissions. Location-related results may also depend on Apple Core Location, Apple Maps or MapKit services, GPS and other positioning sources, device sensors, compass or heading information, altitude information, atmospheric pressure information, reduced-accuracy settings, signal conditions, hardware capability, environmental interference, and Apple system behavior. Location names, coordinates, heading, altitude, atmospheric values, and related results may be inaccurate, stale, incomplete, unavailable, or different from real-world conditions. If location access is unavailable or unsuitable, the App may use a fallback or manually selected observer location for supported functionality. You are responsible for confirming the active observer location before relying on location-dependent results. Ultrasyde must not be used as an emergency-location service, surveying instrument, legal location record, certified compass, altimeter, navigation tool, or safety-critical positioning system. 10. Motion and Device Sensors Ultrasyde may use Apple-provided motion, orientation, heading, and related sensor information to support sky orientation, viewing, camera alignment, or interactive simulation. Sensor readings can be affected by device hardware, calibration, magnetic interference, accessories, device orientation, environmental conditions, system filtering, operating-system behavior, and user movement. The Developer does not guarantee that the App’s orientation, pointing, alignment, heading, or motion representation exactly corresponds to the physical world. 11. Camera, Sky Overlay, and Photos Ultrasyde may provide camera functionality and may allow astronomy-related graphics or sky information to be displayed with a live camera view or incorporated into a captured image. Camera images, displayed sky alignment, object positions, overlays, field-of-view matching, orientation, cropping, rendering, timing, and exported results may differ from actual celestial positions or from what the camera physically records. A sky overlay is a visualization aid, not a certified augmented-reality measurement, navigation, surveying, or telescope-pointing system. Camera availability and image capture depend on device hardware, permissions, Apple camera frameworks, system resources, orientation, storage, thermal or performance conditions, and other device factors. Saving a captured image may depend on Apple Photos permissions and Apple-managed photo-library behavior. The Developer cannot guarantee that every capture, render, export, or save operation will succeed. You are responsible for reviewing captured and saved images and for maintaining any copies you consider important. 12. User Photos and Profile Information Ultrasyde may allow you to provide limited profile information, including a display name and a selected profile image, and may allow you to capture or save photographs. You are responsible for ensuring that you have the rights and permissions necessary for any name, image, photograph, or other content you select, capture, use, save, or share through the App. The Developer is not responsible for content you provide, photographs you capture, or consequences of content you save, publish, disclose, or share. 13. Local App Profile and Local Data Ultrasyde does not currently provide a Developer-operated server account system. A profile or similar identity shown inside the App is a local App profile unless the App clearly states otherwise in a future version. Certain App information, preferences, profile information, selected observer-location information, feature state, and usage state may be stored locally on your device. The Developer does not guarantee that local App data will survive App deletion, device loss, device failure, operating-system changes, storage failure, restoration, migration, reset, corruption, or other events. You are responsible for maintaining separate copies of any information or photographs that are important to you. 14. Apple Services Ultrasyde may rely on Apple-provided frameworks, services, hardware interfaces, and system behavior, including, where applicable, iOS, Core Location, MapKit or Apple Maps, Core Motion, camera frameworks, Photos, Metal, StoreKit, App Store services, system time and calendar services, and device hardware. Those systems are controlled partly or entirely by Apple and may change, fail, become unavailable, behave differently, impose restrictions, or vary by device, region, account, operating-system version, permission state, network condition, or Apple policy. The Developer does not control Apple services, Apple Accounts, App Store availability, StoreKit, Apple billing systems, Apple Maps data, system permissions, hardware behavior, operating-system behavior, or Apple service interruptions. When you use Apple services or another third-party service in connection with Ultrasyde, you must comply with the applicable terms of that service. 15. Premium Features and Free Usage Limits Ultrasyde may provide free access to certain features subject to usage limits and may offer additional or expanded functionality through Ultrasyde Premium. Free-use limits, premium limits, included functionality, eligibility, feature availability, and access rules may be modified in future versions for technical, security, legal, product, business, performance, or App Store compliance reasons, subject to applicable law and Apple requirements. A free-use allowance is not a purchased entitlement and does not guarantee permanent access to the same quantity, frequency, feature set, or reset behavior. Premium access does not guarantee that every premium feature, limit, design, workflow, astronomical target, simulation behavior, or capability will remain unchanged forever. 16. Auto-Renewable Subscription Ultrasyde may offer an auto-renewable annual subscription through Apple’s App Store and StoreKit. Payment is charged through the Apple Account used for the purchase. The subscription renews automatically unless canceled in accordance with Apple’s subscription-management rules. Apple manages payment processing, billing, renewal, cancellation, pricing presentation, regional pricing, taxes, currency conversion, payment authorization, billing retry, refunds, chargebacks, purchase verification, offer eligibility, App Store account status, and related financial transaction processes. The Developer does not receive or store your full payment-card details and does not control Apple’s billing infrastructure, refund decisions, payment authorization, tax handling, or subscription-management systems. Deleting Ultrasyde does not necessarily cancel an active subscription. You are responsible for managing or canceling subscriptions through Apple’s subscription-management tools. To the maximum extent permitted by applicable law, the Developer is not responsible for Apple-controlled billing, renewal, cancellation, refund, tax, pricing, payment, eligibility, StoreKit, App Store account, or financial transaction processes. 17. Premium Entitlement and Restore Premium access depends on a valid entitlement recognized through Apple StoreKit and may be affected by Apple Account status, transaction availability, purchase verification, subscription status, device state, network availability, App Store service status, regional restrictions, or Apple system behavior. Entitlement recognition may be delayed, unavailable, interrupted, or temporarily inconsistent. Restore functionality relies on Apple’s systems and does not guarantee that a transaction or active entitlement will be available immediately. The Developer is not responsible for delays or failures caused by Apple-controlled subscription or entitlement systems, except to the extent applicable law requires otherwise. 18. Changes to Features, Availability, and Development The Developer may update, improve, modify, replace, limit, suspend, rename, reorganize, or discontinue App features, premium features, free features, simulations, content, supported devices, supported date ranges, usage limits, integrations, or workflows. Changes may be made for technical, scientific, security, privacy, legal, product, performance, compatibility, business, App Store, Apple policy, or maintenance reasons. The App or its development, support, sale, subscription offering, or availability may also be discontinued or removed from the App Store. Nothing in these Terms guarantees permanent availability of the App or any particular feature, provided that mandatory consumer rights and Apple requirements remain unaffected. 19. Updates and Compatibility Ultrasyde may require updates to remain compatible with supported devices, iOS versions, Apple frameworks, App Store requirements, or Apple services. Operating-system updates, device changes, Apple framework changes, App updates, interrupted updates, insufficient storage, hardware limitations, data migration, or future Apple policies may affect performance, compatibility, saved state, premium access, calculations, rendering, sensors, camera behavior, or feature availability. The Developer does not guarantee compatibility with every present or future Apple device, operating-system version, hardware configuration, or Apple service. 20. Performance and Device Conditions Astronomical simulation, graphics rendering, camera processing, motion tracking, and other features may use significant device resources depending on your device and how you use the App. Performance, frame rate, rendering quality, camera operation, responsiveness, thermal behavior, and battery consumption may vary based on device model, system load, battery state, Low Power Mode, thermal conditions, available memory, storage, operating-system behavior, and other factors. The Developer does not guarantee a specific frame rate, battery consumption level, thermal condition, rendering quality, or performance level on every device. 21. Safety and Responsible Use Do not use Ultrasyde in a way that distracts you while driving, cycling, operating machinery, walking in hazardous environments, or performing any activity requiring attention. Do not rely on Ultrasyde for navigation, emergency response, personal safety, aviation, marine operation, vehicle operation, legal compliance, professional surveying, or any safety-critical decision. You are solely responsible for your surroundings, equipment, physical safety, and lawful device use. 22. No Professional or Scientific Certification Ultrasyde is intended for general astronomy exploration, simulation, visualization, informational, educational, creative, and entertainment use. The App does not provide professional scientific certification, peer-reviewed research conclusions, legal advice, safety advice, engineering advice, navigational advice, or professional observational guarantees. Use of scientific terminology, astronomical terminology, calculated values, catalogs, physical units, or realistic visualization does not mean that a result has been professionally verified, certified, guaranteed, or approved for professional use. 23. Intellectual Property Ultrasyde, including its original software, source code, design, structure, organization, user interface, visual systems, simulations, algorithms, graphics, branding, and original content, is protected by applicable intellectual-property laws. Except for the limited license expressly granted to you, all rights in the App are reserved by the Developer and applicable rights holders. You retain responsibility for content that you lawfully provide to or create with the App. You may not use Ultrasyde to infringe copyrights, trademarks, privacy rights, publicity rights, contractual rights, or other rights of any person. 24. No Guarantee of Uninterrupted or Error-Free Operation Ultrasyde is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law. The App may contain defects, inaccuracies, limitations, interruptions, unavailable features, rendering differences, calculation errors, sensor errors, camera errors, location errors, subscription-state delays, compatibility problems, or other unexpected behavior. The Developer does not guarantee that the App will be uninterrupted, error-free, bug-free, completely accurate, always available, always secure, compatible with every device, or free from data loss. 25. Disclaimer of Warranties To the maximum extent permitted by applicable law, the Developer disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, quiet enjoyment, and non-infringement, where such disclaimers are legally permitted. The Developer does not warrant that: • Astronomical calculations or event times will always be correct • Celestial positions or sky overlays will always align with reality • Location, heading, altitude, pressure, motion, or sensor results will always be accurate • Camera capture, rendering, export, or photo saving will always succeed • Simulated or generated space content will correspond exactly to the real universe • Premium features or free-use limits will remain unchanged • Subscriptions or entitlements will always refresh immediately • Apple services will always be available • The App will remain compatible with future devices or operating-system versions • The App will meet every user’s expectations or intended purpose Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded. 26. Limitation of Liability To the maximum extent permitted by applicable law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, punitive, economic, business, reputational, data-related, or similar damages arising out of or related to the App or your use of it. This includes, without limitation, losses or consequences arising from: • Inaccurate astronomical calculations, event information, positions, timing, or visibility • Incorrect or stale location, heading, altitude, motion, pressure, or sensor information • Misaligned or inaccurate camera sky overlays • Failed, missing, altered, or incorrectly saved photographs • Reliance on simulated, approximated, generated, stylized, or visualized content • Missed astronomical observations, travel, photography opportunities, or planned activities • Device distraction or unsafe use • Data loss, App deletion, device loss, storage failure, migration failure, or reset • App bugs, crashes, performance issues, thermal behavior, or incompatibility • Premium entitlement delays or feature changes • App Store, StoreKit, Apple Account, payment, billing, renewal, cancellation, refund, pricing, tax, or subscription issues • Apple service outages, Apple policy changes, operating-system changes, permission changes, or hardware behavior • App updates, feature removal, App Store removal, suspension, or discontinued development • Events outside the Developer’s reasonable control Where applicable law permits a contractual liability cap, the Developer’s total aggregate liability arising from or relating to the App or these Terms will not exceed the amount you actually paid for Ultrasyde through the App Store during the twelve months immediately preceding the event giving rise to the claim. If you paid nothing during that period, the maximum aggregate liability will be USD 10 or the minimum amount required by applicable law, whichever is greater. These limitations do not apply to liability that cannot legally be excluded or limited. 27. User Responsibility You are responsible for: • Using Ultrasyde lawfully and safely • Managing your Apple Account, device, permissions, subscriptions, storage, and system settings • Confirming the location, date, time, and other relevant settings before relying on App results • Independently verifying astronomy-related information when accuracy matters • Reviewing photographs, saved results, and premium status • Maintaining copies of important photographs or information outside the App • Avoiding use of the App for safety-critical, navigation-critical, emergency, or professionally certified purposes • Protecting your device and controlling who can access App content • Respecting third-party intellectual-property, privacy, contractual, and other legal rights 28. Indemnification for Unlawful Misuse To the extent permitted by applicable law, you agree to indemnify and hold the Developer harmless from third-party claims, liabilities, damages, losses, and reasonable costs arising directly from your unlawful misuse of the App, your intentional violation of these Terms, or content you provide or use in violation of another person’s rights. This section does not require you to indemnify the Developer for liability that applicable law places on the Developer and does not limit mandatory consumer rights. 29. Product Claims and Apple To the extent required by applicable Apple terms, the Developer, not Apple, is responsible for addressing claims relating to Ultrasyde or your possession or use of the App, including product-liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar law. In the event of a third-party claim that Ultrasyde or your possession and use of Ultrasyde infringes that third party’s intellectual-property rights, responsibility will be allocated as required by applicable law and applicable Apple terms. Apple has no warranty obligation for Ultrasyde beyond obligations Apple expressly assumes under its own terms or applicable law. 30. Legal Compliance, Export Controls, and Sanctions You may not use, export, re-export, or otherwise make the App available in violation of applicable laws, sanctions, trade restrictions, export-control laws, or Apple rules. You represent that your use of the App is lawful in the country or region in which you use it and that you are not prohibited from using the App under applicable sanctions or restricted-party rules. 31. Force Majeure To the maximum extent permitted by applicable law, the Developer is not responsible for delay, interruption, unavailability, failure, data issues, subscription issues, or other consequences caused by events outside the Developer’s reasonable control, including natural disasters, war, civil unrest, governmental action, legal restrictions, power failures, internet or infrastructure failures, security incidents, platform outages, Apple service failures, App Store interruptions, labor disruptions, pandemics, or similar events. 32. Privacy Your use of Ultrasyde is also governed by the Ultrasyde Privacy Policy: https://aliyigxt.github.io/Ultrasyde/Ultrasyde_Privacy_Policy.txt The Privacy Policy describes how information is handled in connection with the App and Apple-managed services. 33. Suspension and Termination You may stop using Ultrasyde at any time. The Developer may suspend or terminate your right to use the App if you materially violate these Terms, unlawfully misuse the App, attempt to bypass subscription or security mechanisms, infringe third-party rights, or use the App in a manner that creates material legal or technical risk. Termination does not create a right to a refund except where required by applicable law or Apple’s applicable refund rules. Deleting the App does not necessarily cancel an active App Store subscription. Sections that by their nature should survive termination, including intellectual-property, disclaimers, limitations of liability, indemnification, and legal-compliance provisions, will survive to the extent permitted by applicable law. 34. Changes to These Terms The Developer may update these Terms from time to time to reflect changes to the App, law, Apple requirements, security, subscriptions, features, or business practices. The current version will display its “Last updated” date. Where applicable law requires notice or renewed consent for a material change, the Developer will comply with that requirement. Otherwise, continued use of Ultrasyde after updated Terms become available constitutes acceptance of the updated Terms to the extent permitted by applicable law. 35. Governing Law and Mandatory Consumer Rights To the extent permitted by applicable law, these Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. If you are a consumer, nothing in these Terms deprives you of mandatory consumer-protection rights, remedies, or jurisdictional protections that cannot legally be waived under the laws applicable to you. Any court, tribunal, or dispute-resolution venue will be determined in accordance with applicable mandatory law. 36. Severability and No Waiver If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed as necessary, and the remaining provisions will remain in effect. A failure by the Developer to enforce any provision or right does not waive that provision or right. 37. Entire Agreement These Terms, together with the Ultrasyde Privacy Policy and the Apple terms that apply to your use of the App, constitute the applicable agreement regarding your use of Ultrasyde, except where additional mandatory terms apply. Headings are for convenience and do not limit the meaning of any provision. 38.
